Matthew C. Gaudet is a trial lawyer who practices in the area of intellectual property litigation with a focus on patent litigation as well as related complex commercial litigation and technology litigation. He has successfully tried numerous cases, has defeated dozens of patents prior to trial, and has appeared before panels of the U.S. Court of Appeals, the Judicial Panel on Multidistrict Litigation and federal district courts across the country.

In 2011, Mr. Gaudet was named one of Law360's Five IP Lawyers Under 40 to Watch, describing him as "a deadly cross-examiner." From 2009 through 2013, Chambers USA: America's Leading Lawyers for Business included Mr. Gaudet in its listing of leading IP lawyers in Georgia. Mr. Gaudet is also listed in Best Lawyers in America and the "Top 100" of Georgia Super Lawyers.

Mr. Gaudet regularly lectures on patent litigation topics. Before entering private practice, he served a judicial clerkship for the Honorable Susan H. Black of the US Court of Appeals for the Eleventh Circuit. A member of the State Bar of Georgia and the New York State Bar Association, Mr. Gaudet is admitted to practice in Georgia and New York. Mr. Gaudet is a 1997 magna cum laude graduate of Duke University School of Law and a magna cum laude graduate of Louisiana State University.

Representative Matters

  • Won jury verdict of infringement for a patent holder against two major automobile manufacturers, resulting in a $15 million judgment and a multimillion-dollar annual ongoing royalty.
  • Won jury verdict for a major Internet Service Provider accused of infringing three patents relating to ADSL technology, in which the jury found the patents not infringed and invalid on numerous grounds.
  • Won a complete defense verdict on all four patents-at-issue for a major manufacturer of cable set-top boxes in the largest Section 337 proceeding ever tried before the International Trade Commission.
  • Won summary judgment of non-infringement in the Eastern District of Texas for a major Internet Service Provider in a complex, multi-party patent infringement matter involving an alleged invention relating to Internet access.
  • Won summary judgment in the District of New Jersey for a medical device manufacturer that a key competitor's patent relating to prosthetic knees is invalid, and did so after taking the case over from prior counsel.
  • Won an order shifting $300,000 of e-discovery costs to a plaintiff patent holding company and a corresponding $87,000 attorneys' fee award against that plaintiff on behalf of a major supplier of hardware for routing e-mail, then won summary judgment of non-infringement and/or invalidity against all patents asserted in the case.
  • Won summary judgment of non-infringement of all eight patents-at-issue for a major manufacturer of cable set-top boxes in complex, multi-district patent and antitrust litigation relating to interactive program guides.
  • Secured dismissal without payment for a major manufacturer of VoIP telephony equipment accused of patent infringement.
  • Secured large settlement for two well-known inventors in the aluminum casting industry in connection with the prosecution of trade secret misappropriation claims and related patent claims.
