R. Terry Parker practices in the area of intellectual property law with a focus on complex commercial litigation involving patents, copyrights, trade secrets, trademarks, trade dress and unfair competition. His clients range from corporations with internationally known products and brands to start-ups in industries such as e-commerce, high-technology and apparel. He has litigated before federal courts throughout the United States and has briefed intellectual property issues before the Second and Eleventh Circuit Courts of Appeals.
Prior to practicing law, Mr. Parker lived and worked in the greater China area for more than fifteen years and is conversant in Mandarin Chinese.
Mr. Parker is a 2008 cum laude graduate of the University of New Hampshire School of Law (formerly Franklin Pierce Law Center), where he was senior editor of the Pierce Law Review, and a graduate of the University of London (International) (LL.B., with honors), the University of Virginia (M.F.A.) and Millsaps College (B.A.).
Representative Matters
- Obtained on behalf of The Bon-Ton Stores, Inc. in the U.S. District Court for the Southern District of New York an order granting a motion to dismiss a complaint which alleged a breach of a settlement agreement, copyright infringement and false advertising under the Lanham Act. Klauber Brothers, Inc. v. Russell-Newman, Inc. and The Bon-Ton Stores, Inc.
- Obtained temporary restraining order and preliminary injunction on behalf of Ben & Jerry's Homemade, Inc. in a case involving claims of infringement, dilution and unfair competition against a film distributor.
- Won a favorable summary judgment decision involving issues of first impression concerning client's cloud-based music storage service in a copyright infringement case brought by a group of major record labels.
- Currently representing plaintiff in patent infringement action against several international corporations involving JPEG technology.
- Currently defending international engineering firm against allegations of copyright infringement and misappropriation of trade secrets concerning technologies related to the manufacture of deep sea oil rigs.
- Won a permanent injunction for software company against a former employee and his new company in a case involving claims of copyright infringement and misappropriation of trade secrets.
- Secured settlement the client found favorable for national retailer Sleepy's in arbitration concerning alleged copyright infringement and misappropriating trade secrets related to retail and supply chain management software.
- Secured dismissal for lack of personal jurisdiction for executives of a music search-engine in a copyright infringement case brought by a group of major record labels.
- Secured large settlement for Anthropologie in a case involving the copyright infringement of client's clothing designs—obtained sanctions award.
- Won $2 million dollar judgment on behalf of a multinational client against a distributor of counterfeit food products.
