Duane Morris Partner Daniel E. Toomey to Moderate Plenary Session at the ABA Forum on the Construction Industry Fall Conference

Duane Morris partner Daniel E. Toomey will be moderating a panel of construction general counsels in a plenary session during the ABA Forum on the Construction Industry Fall Conference, to be held on October 15-16, 2009, in Philadelphia, Pennsylvania. Mr. Toomey's plenary discussion is on the topic of "Business Ethics & Professionalism: Representing the Construction Industry" on Friday, October 16, from 11:30 a.m. to 12:30 p.m. Inside and outside counsel have their respective ethical challenges in the construction industry. This session will explore several of these ethical issues:
- Influencing Without Authority: Distinct Roles for Inside and Outside Counsel—or Are They? (The duties and liabilities of inside counsel contrasted with those of outside counsel and their respective roles with the client.);
- Who Is My Client? (The ethics issues associated with representing a company and its owners/officers/directors amid potential conflicts and potentially divergent interests);
- Multi-Jurisdictional Practice Issues for the Construction Lawyer (The normal issues plus the concern of counsel, inside or outside licensed in one state, handling matters and communications across multiple jurisdictions for their client); and
- Privilege Issues and the In-House Counsel.
About the Conference
This two-day conference, titled "The Two-Way Street of Construction Consulting: Learning from the Ins & Outs," will bring into sharp focus persistent issues facing construction counselors—particularly in-house counsel. It will showcase many notable in-house and outside construction counselors who will take up the many challenges of advising construction industry participants in a lackluster economy. Topics to be covered include: conflicting state laws and regulations, managing complex litigation, workforce and government contract compliance issues, and the Obama administration's impact on the construction industry.
