Duane Morris handles matters involving contract suretyship, including cases dealing with claims against a contractor's payment or performance bond surety, whether on a public or private construction project.
Our lawyers represent multiline insurance companies that furnish surety bonds for the protection of the project owner. Payment and performance bonds, respectively, provide a financial guarantee that specified subcontractors, laborers and materialmen will be paid for labor and materials furnished to a project and that the project will be completed in accordance with the contract documents.
We also deal with matters involving pursuing the contract surety's right of equitable subrogation to contract balances, as well as its right of indemnification from the surety's indemnitors.
Duane Morris also handles cases involving fidelity bond law and litigation. These fidelity cases involve blanket and schedule bonds issued on behalf of commercial and financial institutions providing coverage for fraud or dishonesty of the insured's employees.
